There are many things that are legal and unethical and vice versa, ethical and illegal. For example, breaking a promise or not sticking with your word is unethical but rarely if ever illegal. The opposite goes for jaywalking it is illegal but in almost no case is it unethical. So now in the case of photography; there are many laws here in the United States that involve photography but there are a few main points starting with the broadest, that if you are in public it is legal for someone to take a photograph of you. The law however does protect from many circumstances including when you are in a private residence with the photographer and if you are in a place of implied privacy. There are many examples of places with implied privacy these include bathrooms, changing rooms, and locker rooms. With these laws in place, one might think any legal photo is ethical and any illegal photo is not however this is not the case. Here are a few examples of cases where this is the case: If someone has to stalk you to get into a situation to take a photograph it is unethical. This then takes another step, if someone has to break the law to take a photograph of you the photo is unethical even if taking the picture was legal. This is often the case with celebrity pictures however it happens to many more than you think. Another example of unethical photography is when pictures are taken of someone who is not in the right state of mind, often drunk. Many photos are taken at bars or parties of people who are acting funny but that is not right if they do not want the picture taken because their futures can be affected by someone else unknowingly taking a picture of them. Finally an example of a situation where it is illegal to take a photo but in my opinion is ethical is in a place like Congress or many courtrooms where it is not allowed. These are public spaces and therefore it is ethical for these places to be documented by the said public. Overall legality does not mean it is ethical in anything including photography.
